Maryland enacted the Protection of Homeowners in Foreclosure Act (also called PHIFA) which affects certain aspects of sales and other transactions involving homes in foreclosure. Be warned - certain investment advice, particularly along the lines of "make money quick in real estate" may suggest activities which are illegal under this Act. Unsure? Ask an attorney to review your proposed transaction.
Maryland law allows one co-owner to force the sale of real estate when the other owner(s) won't budge. This is by a special lawsuit called a "Sale in Lieu of Partition" action. In many cases, it makes sense to reach agreement on a buy-out but the law provides a mechanism when joint owners simple won't agree to sell. |
