Many people wish to avoid probate.  Sometimes, however, adding children or grandchildren to a property creates unexpected problems -- once listed as a joint owner, the creditors of a child or grandchild could later force a sale even against the original owner's wishes.  A Life Estate Deed offers greater protection and can combine the best of two worlds - if worded properly it can allow another person to be named on the deed and get property automatically after the original owner's death (avoiding probate) WHILE allowing an original owner to keep full, unfettered control during their lifetime.

PHIFA?

Maryland enacted the Protection of Homeowners in Foreclosure Act (also called PHIFA) which affects certain aspects of sales and other transactions involving homes in foreclosure.  Be warned - certain investment advice, particularly along the lines of "make money quick in real estate" may suggest activities which are illegal under this Act.   Unsure?  Ask an attorney to review your proposed transaction.   

 
Maryland law allows one co-owner to force the sale of real estate when the other owner(s) won't budge.  This is by a special lawsuit called a "Sale in Lieu of Partition" action.   In many cases, it makes sense to reach agreement on a buy-out but the law provides a mechanism when joint owners simple won't agree to sell.
